MANIFOLD ACCESSORY License Version 1.0a

Mount Baker Games makes available many of its copyrighted assets for use in educational, creative, or commercial works. This License extends to Manifold TCG’s Card Imagery, dice faces, character names, form and type assets, and narrative descriptions. This License does not extend to using our card faces, or mechanically similar facsimiles, as game pieces in either the physical or digital format, or for the creation of Standard Playing Cards or similarly sized trading cards. Using these assets does not mean you own Manifold TCG, nor claim any ownership to any assets made available through this License. This License will remain in effect until December 31, 2029. Content made legally under this License may continue to be distributed after that date, but new content must comply with any replacement Accessory License published by Mount Baker Games.

1. Definitions:

"Contributors" means the copyright and/or trademark owners who have contributed Manifold Accessory Content;
"Distribute" means to reproduce, License, rent, lease, sell, broadcast, publicly display, transmit or otherwise distribute;
"Product Identity" means product and product line names, logos and identifying marks including trade dress; artifacts; creatures, characters; stories, storylines, plots, thematic elements, dialogue, incidents, language, artwork, symbols, designs, depictions, likenesses, formats, poses, concepts, themes and graphic, photographic and other visual or audio representations; names and descriptions of characters, spells, enchantments, personalities, teams, personas, likenesses and special abilities; places, locations, environments, creatures, equipment, magical or supernatural abilities or effects, logos, symbols, or graphic designs; and any other trademark or registered trademark clearly identified as Product identity by the owner of the Product Identity, and which specifically excludes the Manifold Accessory Content;
"Trademark" means the logos, names, mark, sign, motto, designs that are used by a Contributor to identify itself or its products or the associated products contributed to the Manifold Accessory License by the Contributor.
"Use", "Used" or "Using" means to use, Distribute, copy, edit, format, modify, translate and otherwise create Derivative Material of Manifold Accessory Content.
"You" or "Your" means the Licensee in terms of this agreement.

2. The License:

This License allows creators to create and distribute digital media or physical accessories which use the assets defined in this License. You retain copyright in your original contributions, but you do not acquire any ownership of Manifold TCG or the Manifold Accessory Content. You may not assert or imply ownership over Manifold Accessory Content or Product Identity. No terms may be added to or subtracted from this License except as described by the License itself. No other terms or conditions may be applied to any Manifold Accessory Content distributed using this License. This does not prevent You from applying separate terms or conditions to Your own original contributions, provided those terms do not conflict with this License or purport to restrict the Manifold Accessory Content itself.

3. Included Works:

This License extends to both digital and physical fabrications including Manifold TCG assets. The assets made available through this License include:

Dice Faces and dice symbols.
Card Type frame shape, Card Form frame texture.
Character and card names and descriptions.
Manifold Lore event and location names and descriptions.
Full card faces, for use in non-gamepiece formats such as books, websites, and reference materials, except as limited in the ‘Excluded Works’ section.
Any Manifold TCG card imagery created through Midjourney that Mount Baker Games has designated as Manifold Accessory Content is available for your use under this License, subject to Midjourney’s commercial terms. This License does not grant any rights in Midjourney’s service itself or in artwork not expressly designated by Mount Baker Games.

4. Excluded Works:

This License does not allow for the use of full card faces, or mechanically similar facsimiles, to be fabricated or distributed as game pieces in either the digital or physical format. This License does not allow for the use of full card faces, or mechanically similar facsimiles, to be produced as Standard Playing Cards, or similarly sized cards in the physical format.

5. Offer and Acceptance:

By Using the Manifold Accessory Content You indicate Your acceptance of the terms of this License.

6. Grant and Consideration:

In consideration for agreeing to use this License, the Contributors grant You a worldwide, royalty-free, non-exclusive License with the exact terms of this License to use the Manifold Accessory Content. This License will remain in effect until December 31, 2029. After that date, Mount Baker Games may publish an updated or replacement License. Any products you published and distributed under a valid version of this License before its replacement may continue to be distributed under the terms of that version.

7. Acceptable Compatibility Descriptors:

You agree not to describe yourself as an officially Licensed product, but may use any of the purpose.

Any such description must be accompanied by a statement substantially similar to: ‘This product is not affiliated with, endorsed, sponsored, or specifically approved by Mount Baker Games.’

8. Use of Product Identity:

You agree not to describe yourself as Mount Baker Games. You agree that any indication of compatibility or co-adaptability with any Trademark or Registered Trademark in conjunction with a work containing Manifold Accessory Content does not extend to ownership of the products that you indicate compatibility with. The use of any Product Identity in a work that also contains Manifold Accessory Content does not constitute a challenge to the ownership of that Product Identity, or a challenge of ownership to Manifold TCG or its Accessory content. The owner of any Product Identity used in a work under this License shall retain all rights, title and interest in and to that Product Identity.

9. Identification:

If you distribute Manifold Accessory Content You must clearly indicate which portions of the work that you are distributing are Manifold Accessory Content.

10. Designation of Authority to Contribute:

Only Mount Baker Games or its designated agents may designate content as Manifold Accessory Content.

11. Updating the License:

Mount Baker Games or its designated Agents may publish updated versions of this License. You may use any authorized version of this License to copy, modify and distribute any Manifold Accessory Content originally distributed under any version of this License.

12. Use of Contributor Credits:

You may not market or advertise the Manifold Accessory Content using the name of any Contributor unless You have written permission from the Contributor to do so.

13. Inability to Comply:

If it is impossible for You to comply with any of the terms of this License with respect to some or all of the Manifold Accessory Content due to statute, judicial order, or governmental regulation then You may not Use any Manifold Accessory Content so affected.

14. Condemnation:

You will not use the assets made available in this License to create content that is illegal, hateful, or pornographic.

15. Termination:

This License will terminate automatically if You fail to comply with all terms herein and fail to cure such breach within 30 days of becoming aware of the breach.

16. Reformation:

If any provision of this License is held to be unenforceable, such provision shall be reformed only to the extent necessary to make it enforceable.
